If you are ever the victim of someone else’s negligence, you must realize that the insurance adjuster’s job security and raises depend on saving the insurance company money. So what are you likely to face?
DENIAL OF COVERAGE
Early on in a claim, the adjuster will contact the insured to investigate the facts of the claim and to look for ways to deny coverage. A late premium payment, an unlisted driver in the household, and others are typical reasons to deny coverage.
YOUR STATEMENT
The adjuster will also want to contact you to investigate the insured’s liability and to attempt to settle the matter quickly. Statistics show that insurance companies pay much less when they settle claims before the full measure of damages can be discovered and before the claimants have time to get an attorney involved. Remember, once you sign a release, your case is closed forever.
DEFENSE HIRED EXPERTS
Medical expert. The defense will send you to a doctor hand-picked by the insurer or by its attorneys. That doctor will usually examine you, review your records, and testify that either you are not injured as much as you say or that your condition is due to the natural aging process. In short, the insurance company hires and pays a doctor to call you a liar, a malingerer, and a cheat.
Biomechanical expert. This expert will review the mechanism of your injury claim (i.e. crash or fall, etc.) and then cite to studies of similar incidents where other people did not get hurt. They then strongly suggest that you must not have gotten hurt either. Again, they are calling you a liar.
Accident reconstructionist. If you were in a wreck, these experts examine the scene and the cars involved (or, more often, they only examine photographs) to come up with their opinions of the forces involved in the wreck. They then try to claim that there is a magical figure for the amount of force it takes to injure a particular body part. Although tempting for juries to believe, this is a complete fallacy, as there is no way to establish an injury threshold for any individual person unless you take that person out and crash into them continuously until they actually get hurt.
