Eric A. Seiken

Eric A. Seiken is a founding shareholder of Seiken & Atkins, APC, who specializes in plaintiffs' litigation, with an emphasis in helping victims of medical malpractice and catastrophic personal injuries, including wrongful death, spinal cord injuries, product liability and brain injuries.

An undergraduate psychology major at
Penn State University, Mr. Seiken was an active member in the University Student Affairs Program, as well as an active member within the community surrounding the college. While attending college full-time, Mr. Seiken took great joy in helping those less fortunate as he was regularly involved in the fund-raising efforts of the Centre County Special Olympics, at one point acting as the Chairman for the Centre County Special Olympics Annual Fund-raising Drive. An avid sports fan, Mr. Seiken capitalized upon the many sporting activities at Penn State when he served as manager for the men's basketball team, which in his senior year, won the Atlantic-10 conference title and upset then fifth-seeded UCLA in the NCAA Men's Basketball Tournament.

Upon his graduation from Penn State in 1991, Mr. Seiken obtained his legal education at
California Western School of Law, earning a merit scholarship and graduating in the top twelve percent of his class. While at California Western, Mr. Seiken was able to combine his love of sports with academics as he authored an article published by Penguin Publishing, which detailed the impact of Federal anti-trust laws upon the NCAA and its respective television contracts. He continued to satisfy his desire to help those in need as he regularly volunteered his time to the offices of the Alternate Public Defender, performing pro bono legal services to children caught within the County of San Diego's Juvenile Dependency Program. Mr. Seiken graduated in December, 1993, with honors, having completed law school within two years.

Upon his graduation from law school, Mr. Seiken practiced in various firms, for both plaintiffs and defendants, emphasizing in personal injury matters of all types, including several million dollar cases. His focus is on plaintiffs' injury work because he takes great pride in seeing a smile on his client's face knowing he has helped them move on from a difficult period in their lives. Mr. Seiken takes advantage of his past experience representing defendants, including insurance companies, to maximize the monetary amounts he is able to secure for his clients.

Mr. Seiken is a member of the
State Bar of California and the State Bar of Colorado. He is also licensed to practice before the United States Court of Federal Claims in Washington, D.C. His professional associations include the San Diego County Bar Association; Association of Trial Lawyers of America; Consumer Attorneys of California; and Consumer Attorneys of San Diego. It is in this latter group where Mr. Seiken regularly volunteers his time as a judge for the Association's mock trial competition, which allows him to advise student participants on courtroom strategies and trial tactics. Mr. Seiken continues to devote significant time and energy to those less fortunate as a member of the Board of Directors for the San Diego Brain Injury Foundation and as Co-Chairman for the Foundations' annual golf tournament. Mr. Seiken also represented pro bono the family of a young businessman tragically killed in the September 11, 2001 terrorist attacks on the World Trade Center, securing a multi-million dollar award under the federal government's Victims Compensation Fund.

James T. Atkins

James T. Atkins

James T. Atkins is the co-founder of Seiken & Atkins, A.P.C. His areas of practice include serious personal injury, construction defect, employment, products liability and business torts litigation. Mr. Atkins also includes estate planning and probate administration in his practice.

Following his graduation from high school, Mr. Atkins enlisted in the
United States Navy and served at sea aboard the nuclear-powered fast attack submarine, USS Bluefish (SSN 675), and later aboard the San Diego-based Amphibious Assault Ship, USS Tripoli (LPH-10).

Following his military service, Mr. Atkins attended
San Diego State University and was awarded the Bachelor of Arts degree in English, cum laude, with departmental distinction. Mr. Atkins was accepted into the inaugural Master of Fine Arts program in poetry writing at SDSU, which he attended while awaiting admission to law school.

Mr. Atkins earned his law degree from
California Western School of Law in San Diego in 1995, where he emphasized both estate planning and litigation skills. As a full-time student at Cal Western, Mr. Atkins clerked for a prominent San Diego Plaintiffs’ law firm. Upon graduation, Mr. Atkins was retained as an Associate of the firm where he secured settlements and verdicts in excess of twenty million dollars on behalf of individuals harmed or killed in automobile accidents, by exposure to pesticides and mold, by inadequately labeled pharmaceuticals and medical malpractice.

Mr. Atkins has also obtained substantial recoveries for homeowners whose homes were defectively built. In one of his favorite cases, Mr. Atkins participated in the representation of more than 100 families whose homes were buried or rendered valueless by a landslide caused by over-irrigation of uphill citrus and avocado groves.

Mr. Atkins’ recent pro bono activities includes representation of families whose homes were destroyed by the October 2003 wildfires in San Diego County. Mr. Atkins has assisted families in negotiating settlements with their insurers in order to provide sufficient funding for the families to rebuild their homes and replace belongings.

Mr. Atkins is a PTA member and is the Legislative Representative of his children’s school for the
9th District PTA, and is a member of the San Diego chapter of Mothers Against Drunk Driving (MADD).

Mr. Atkins is admitted to practice law before all of the California State Courts and the
United States Federal District Court, Southern California. He has also been admitted pro hac vice to the Federal District Court, District of Montana and the Southern District of Arizona, as well as in the Superior Court for the State of Arizona, Yuma. Mr. Atkins’ professional associations include the American Bar Association, Association of Trial Lawyers of America, Consumer Attorneys of California, Consumer Attorneys of San Diego, the San Diego County Bar Association and the San Diego Lawyers Club.
