Proving Personal Injury Claims

In order to prevail against the person or organization (defendant) that caused your injury, your personal injury attorney must prove the following by a preponderance of the evidence (or in other words, after all the evidence is weighed that the matter is more probably true than not):

  • Duty: That the defendant owed a duty to you to exercise reasonable care. An example of duty of care is an owner of real estate owes a duty of reasonable care under the circumstances to those lawfully on their premises.

  • Breach of Duty (Negligence): That the defendant breached its duty of care or, in other words, failed to exercise reasonable care under the circumstances. This is known as Negligence. An example of breach of duty is an operator of a car rear-ending another car stopped at a red light.

  • Proximate Cause: That the defendant's negligence was a cause of your injury or harm.

F. Robert Allison began his legal career as an Assistant District Attorney in Essex County where he prosecuted numerous criminal cases in courtrooms throughout Essex County.

Upon leaving the District Attorney's office, Mr. Allison worked as an associate in private practice where he focused on personal injury law and real estate.

Mr. Allison established his own practice in 1992 in Salem, Massachusetts where he continues to concentrate on personal injury law and real estate.

Over the years, Mr. Allison has successfully handled numerous personal injury claims including automobile claims, product liability claims, dog bite cases, motorcycle accidents, brain injuries, construction accidents, burn injuries, slip and falls, wrongful death claims and toxic chemical claims.

Some of Mr. Allison's recent cases have included carbon monoxide poisoning from a defective boiler, severe ankle fracture from a slip and fall on a walkway covered by snow and ice, a severe nerve injury rendering our client incapable of working as a result of injuries he suffered in a motorcycle accident, a client undergoing back surgery as a result of injuries sustained in an automobile accident, and an elderly lady sustaining a severe laceration to her leg requiring a skin graft after being struck by a dolly in a supermarket.

Mr. Allison is a member of the Massachusetts Bar Association, the Essex County Bar Association, the Real Estate Bar Association, and the Massachusetts Academy of Trial Attorneys. He has also been on the Board of Directors of the Visiting Nurse Association of Lynn for fifteen years.
