Aaron James, 70 AD 2d 939, 417 NYS 2d 517: Appellate Division Second Dept. held that on the facts of this case assault in the second degree was a lesser included offense of robbery in the second degree[appellant convicted of two counts of robbery two] and dismissed the assault, despite a suggestive showup. Jones of NY Court of Appeals was trial counsel for co-defendant Latif). Bruce Maffeo was the ADA and Kenneth E. Bruce the attorney for co-defendant Milton Cotto. A fourth alleged perp has never been arrested.

• Death Penalty Reversed by US Supreme Court WilliamGause v.Arizona 409 US 815, 93 SCt 192 (1972)(brief with BI Rabinovitz).The Arizona Supreme Court had held in State v. Gause, 107 Ariz 491, 489 P 2d 830 (1971) that a victim's fear of a person is probative evidence of the ID of the killer. As a youngster I went to see Bill Gause on Death Row in Florence AZ. Since then I have visited prisoners at Sing Sing, Clinton, Danemora, Attica, Auburn, MCC, Tombs, Bronx House, Brooklyn House, Queens House of Detention, Monroe CO Jail, and many others. (A desk is a dangerous place from which to watch the world. The Honorable Schoolboy by John LeCarre 1977). Visiting Jails is not for the impatient, usually slow getting in and out.
