Insurer's Attempt to Limit Insurance Coverage
The Illinois Supreme Court in Addison Insurance Company v. Donna Fay et al. rejected an insurer’s attempt to limit an insurance policyholder's coverage. The Supreme Cout ruled that the two boys' deaths on the property of the insured were two occurrences, meaning that the deaths were not a single occurrence as the insurer had attempted to convey. The court protected the insured and ruled that the insurer could not meet its burden of proving that its insurance policy limitation was relevant to the case facts.
Uninsured Motorists Cases Need To Be Carefully Evaluated by an Attorney
A binding arbitration agreement between an injured uninsured motorist claimant and her insurer did not bar her subsequent lawsuit alleging the insurer’s unreasonable and vexatious delay in handling her claim. In Smith v State Farm, the court reviewed the trial court’s order of summary judgment in favor of State Farm and against the insured plaintiff. The circuit court granted summary judgment on the basis that the binding arbitration agreement barred the insured’s bad faith action and that no evidence of bad faith by State Farm existed. Corey E. Meyer

Scott Blumenshine
Cook County attorney Scott Blumenshine represents people who seek proper payment of insurance claims of all kinds, from personal injury cases to flood insurance policies.
