Personal Injury

An injury is always unexpected!

A serious injury can be a life altering event that leaves the injured party not knowing what to do or who to turn to. If your injury was caused by the negligence of someone else the law enables you to receive compensation from the party who caused your injuries. You may be entitled to reimbursement of your current and future medical bills, your lost wages and out of pocket expenses. You may also be entitled to compensation for you pain and suffering and in some cases you can be awarded punitive damages which are designed to punish the person who caused you injury.

Serious injuries can be caused in a variety of ways. Some of the most common ways are automobile accidents, slip and falls, medical mistakes, unsafe products and drugs, dog attacks and work place injuries.

To receive compensation for your injuries you must show the following:

  1. That you have been injured and
  2. That your injury was caused by the negligence of another. Negligence is defined as “the failure to do what a reasonable, conscientious, person is expected to do.”

The person that caused your injuries is, more often than not, going to be represented by an insurance company who has an army of top notched attorneys working for it. This is why it is very important that you do not try to settle your case without the assistance of an experienced lawyer. The insurance company is not working in your best interests although they may try to get you to think they are.

To protect your interests a lawyer should research your case with the “end” in mind. In this case the “end” is how he or she is going to convince a jury that you are a victim who is entitled to compensation. In preparing a case for trial a good lawyer will do a variety of things including requesting medical records, locating potential witnesses, demanding that the other side release important information, taking depositions and locating expert witnesses who can testify on your behalf.

Admittedly most cases settle out of court, but to get the maximum amount of recovery for an injured party a lawyer must be ready, willing and able to take your case to trial. Unfortunately many attorneys, who claim to be “trial attorneys” are scared to death of appearing in court and will do almost anything to make sure your case is never heard by a jury.

An injured person did not choose to get hurt but he or she can choose how they are going to deal with it. Receiving fair and just compensation for your injury can help you answer the serious questions such as:

  1. How am I going to my medical bills?
  2. How am I going to pay my rent or mortgage?
  3. Will my electricity and water be turned off because I can’t pay the bill?
  4. Am I going to have to file bankruptcy?
  5. Am I going to wipe out my life’s savings?
  6. Will my children get to go to college?

When trying to choose an attorney please ask please yourself the following questions:

  1. How long has the attorney been practicing law?
  2. Can he or she provide you with referrals?
  3. Does he or she take the time to listen to you?
  4. Does the attorney explain everything to you or does he pass you off to a paralegal or secretary?
  5. Will the attorney be personally handling your file or will he or she be delegating it to another attorney?
  6. Do you like your attorney? (You are going to spend a great deal of time with your lawyer so you better make sure you like him or her.)
If you or a loved one has been injured choosing the right attorney could be one of the most important decisions of your life. You should take your time and consider all of your options before choosing your attorney. The quality of your future could very well depend on your decision.

Attorney Profile

After ten years in the business world, W. David Johnson decided that he wanted an opportunity to make a real difference in the lives of others so, in 1995, he left his successful career in business and, with his wife and two small children by his side, entered law school.

W. David Johnson received a Bachelor of Arts Degree from Winthrop University in 1986. He graduated from Touro Law School in 1999 and is currently admitted to practice law in South Carolina, New York and The United States Supreme Court. He is a member of the New York Bar Association, The South Carolina Bar Association and the Charleston County Bar Association.

W. David Johnson lives in Mount Pleasant with his wife, Kathy, and two teenage daughters, Ashley and Casey. He is a member of the Charleston Exchange Club and the Charleston Evening Exchange Club. W. David Johnson cherishes his membership in the Charleston Exchange Club because in late October and early November of each year he gets to take his “lawyer hat” off and work at the Coastal Carolina Fair to help raise money for various local charities.

While W. David Johnson’s legal accomplishments are too numerous to mention he is particular proud of the following:

1. In 1997 the weight loss drugs Redux and Pondimun were taken off the market because they were suspected of causing heart problems. W. David Johnson spent the next 10 years helping hundreds of people receive just compensation for their injuries caused by the manufacturers of the drugs.

2. In 2006 W. David Johnson was appointed to represent an indigent man who was charged with very serious criminal offenses. If convicted he would probably spend the majority of his remaining life in prison. W. David Johnson made multiple visits to the jail to speak with his client, who always maintained his innocence. W. David Johnson spent, many, many hours, for which he was not compensated for, investigating the legal and factual aspects of the case. While there were several co-defendants who pled guilty W. David Johnson eventually got all the charges against his client dismissed and he walked out of jail a free man.

3. In 2005, W. David Johnson received a call from an associate who told him that an elderly lady he knew had been raising her 5 grandchildren for the last few years. The children’s mother, who was not fit to raise her children, was attempting to take the children from their grandmother. Unfortunately this wonderful grandmother did not have the means to pay an attorney so W. David Johnson heeded the call and represented her pro bono. W. David Johnson work tirelessly and was eventually able to get everybody to agree that the children belonged with their grandmother. The court approved the agreement and now all the children are healthy and happy with their grandmother and get to spend time with their mother who is doing her best to change her life for the better

W. David Johnson offers free consultations because he loves meeting new people to discuss their legal needs. If you have any legal problem, please call W. David Johnson’s office and schedule an appointment. If he can’t help you with your particular problem he probably knows someone who can.
