How We Handle Cases

We use Basecamp to manage our cases and keep our clients informed.  This system opens up the process so our clients know everything about their case at all times. All case related documents are posted on Basecamp and clients receive an email notice every time a document is uploaded.  The case calendar and To Do Lists are available to see as well.

Staffing and Team Meetings

Each case is staffed by at least one lawyer and two support staff.  The case team meets weekly to review the status and assign tasks.  Clients are welcome to call in to join the team meeting.

Why Bring a Wrongful Termination Case?

A wrongfully terminated employee can recover the following:

  • All lost earnings and benefits
  • Compensatory damges for emotional distress
  • Punitive damages to punish the company
  • All costs and legal fees incurred
  • Interest on the unpaid earnings and benefits
  • Other remedies provided by relevant statutes
  • In some cases, a wrongfully terminated employee can recover their job

When Should You Bring a Wrongful Termination Case?

A wrongfully terminated employee can bring a case as soon as the termination occurs.  It is good to bring the case as soon as possible to prevent the loss of key evidence.  In some cases an employee must first file a “charge” with the Equal Employment Opportunity Commission (EEOC).   However, it is best to consult with an employment attorney before filing with the EEOC.

How Can You Bring a Wrongful Termination Case?

To bring a case, you should find an experienced employment law firm like The Ottinger Firm, P.C.  Here is a guide to help you select a good employment attorney.  Many employees who have been terminated do not have the financial resources to hire a good law firm.  But this should not be a problem.  We take most of these cases on a contingent fee basis.  This means that you don’t pay any legal fees until we win the case.  At that point, the fee is paid out the recovery.
