Recently, Rob was awarded Georgia Rising Star of 2014 by Super Lawyers, an honor bestowed on only 2.5% of attorneys in Georgia. Rob has previously been recognized by his colleagues with a Martindale-Hubbell’s AV Preeminent Rating, a distinction bestowed to only a handful of attorneys. Rob is licensed to practice law in Georgia, Tennessee, Florida, California, and New York. Georgia State University College of LawRob received his Juris Doctor from Georgia State University College of Law in Atlanta, Georgia. Upon graduation, Rob worked as an associate attorney at an international business law firm based in Paris, France. There, Rob honed his advocacy skills while representing companies involved in international litigation and arbitration. While attending Georgia State University College of Law, Rob participated in the Moot Court Appellate Advocacy Program as a Vice-President. Rob was only a handful of students selected by the faculty for Pupil Membership into the Bleckley Inn of Court, a prestigious litigation honors society. During his third year of study, Rob clerked for the Honorable Thelma Cummings-Moore in the Superior Court of Fulton County, Georgia. When not practicing law, Rob enjoys traveling to any location where gambling is legal. His game of choice is No-Limit Texas Hold Em. Rob also is a marathon runner and frequent Atlanta Belt Line walker.

Schenk Smith is an Atlanta personal injury law firm founded by trial lawyers Will Smith and Rob Schenk. Will and Rob represent clients and their loved ones who have been hurt at a nursing home or in a car or truck accident.

Our Approach

While some lawyers either refuse or are unable to take cases to trial, Schenk Smith doesn’t bluff. Unlike many “settlement mill” law firms you see on TV, at Schenk Smith, we are first and foremost personal injury trial attorneys. This means that unless you receive a fair offer, our goal will be to let a jury hear your case. We only settle cases if it is in our client’s best interest.

Our approach is to achieve the most profitable result for our clients under the law. We are also available to our clients throughout the case. In other words, our clients speak directly to our attorneys, not to a manager or paralegal. We get to know you. You get to know us. That is true advocacy.

What We Do

What is the history of Schenk Smith?

Schenk Smith was formed in January of 2013 by trial attorneys Rob Schenk and Will Smith. Both graduated from Georgia State University College of Law and began their practices in different areas.

Directly out of law school, Rob’s practice focused on international business litigation and arbitration. Rob’s cases involved complex disputes between global companies, and took him to courts and locations all over the United States and Europe. During this time, Rob learned the ins and outs of litigation, lawsuits, and winning in court.

Will’s practice involved criminal defense of major felonies. Before forming Schenk Smith, Will had successfully defended clients accused of major crimes, including aggravated battery, sexual assault, kidnapping, and robbery, achieving several acquittals in jury trials.

Although each of their practices placed them in the court room, both Rob and Will wanted a different trial experience. Both wanted to be passionate advocates for a cause, not just present arguments. With that in mind, they made the transition into representing victims of nursing home abuse and those injured in car and truck accidents.

Why do you focus on nursing home neglect, car accidents and truck accidents?

Some personal injury lawyers dabble in all kinds of areas. Negligent Security, food poisoning, premises liability, slip & fall, medical malpractice, defective products, class actions, and more. However, laws continually change, optimal strategies continue to shift, and defense attorneys get wise. Lawyers that “do it all” are often at a disadvantage because, while many principles remain the same throughout each area, there are very important nuances that only experienced veterans will know. Attorneys with a limited practice area, like Schenk Smith, take advantage of a high level of experience in a narrow concentration. At Schenk Smith, a majority of our practice is dedicated to nursing home neglect, car accidents, and truck accidents. Because of this, we are better suited to maximize the value of our cases.

What differentiates Schenk Smith from law firms on TV?

The personal injury law firms that you see advertised on television, billboards, and busses generally operate on a high volume of cases. In other words, the business model of these firms is to take as many cases as possible, and to settle those cases as quickly as possible. This practice is great for the law firm, who can keep steady cash flowing through the door. Unfortunately, because the cases are settled quickly, the client rarely gets full value for the claim.

At Schenk Smith, we do not operate on a high number of cases at once. We can name all of our clients, and their family members, off the top of our heads. We put time and effort into each of our cases, and strive to achieve the highest value for the claim. While we hope that our cases can settle quickly, we do not take anything less than the best for our clients.

Do you receive continuing legal education to stay current on the law?

All lawyers in the State of Georgia are required to attend twelve hours of continuing legal education per year. At Schenk Smith, our lawyers not only fulfill this requirement, but concentrate their education in personal injury trial law.

More importantly, the lawyers at Schenk Smith often sit on panels or host educational seminars directed to other attorneys regarding legal practice, trial practice, and injury law.

Why did you decide to practice law?

Personal injury lawyers Rob Schenk and Will Smith, the founding attorneys at Schenk Smith, both got into law so that they could help people navigate the justice system. Most people that know Rob and Will can tell you that first and foremost, they love to argue and perform. Those two qualities are at the core of who they are as people.

Both utilize that skillset in order to advocate on behalf of injured and victimized people. Folks that have been told “no,” “we don’t believe you are hurt,” or “that’s not my problem.” Folks that cannot speak for themselves.

Will Smith

Will Smith is a trial lawyer with a practice focused on representing clients injured due to the negligence of others.

Will is a lawyer’s lawyer. He has represented clients in both State and Federal Courts, in trial and on appeal, throughout Georgia. His expert legal analysis has been used on various Atlanta News networks.

Will Smith learned the basics of trial work as a prosecutor in the Fulton County Solicitor General’s Office. After the Solicitor’s office, Will joined a boutique law firm in Atlanta focusing on federal litigation. Using his experience from both his previous positions, Will opened his own law firm to represent clients in the surrounding metro areas.

During law school Will was President of Georgia State’s mock trial team and won recognition for his talents inside the courtroom. He was also a team member of the prestigious Jessup Moot Court where he took part in a competition that featured law schools from various nations around the globe. During his second year of law school, Will was given the opportunity to work in the Superior Court of Fulton County on the case, State of Georgia v. Cleveland Clark. The case was heavily covered in the media and resulted in the death penalty for the defendant.

Prior to attending law school Will served as a Sergeant in the United States Marine Corps where he was a member of the Marine Corps Anti-Terrorism Unit, F.A.S.T. Company.

 

 

Many families make the agonizing decision to place loved ones in nursing homes and assisted living facilities with the hope that that loved one will enjoy comfort, rest, and care. Unfortunately, many facilities to not fulfill such hope. Most nursing homes in Georgia are owned or operated by for-profit companies that are motivated by profits instead of the needs of residents. In order to save money, operators of facilities cut corners and expenses. As a result, nursing home workers often lack the required training and do not have the proper attitude of a true caregiver.

After placing a loved one in the care of a nursing home or an assisted living facility, most families do not think twice that their loved one will be cared for. Sadly, it is an unfortunate fact that nursing home neglect and abuse are on the rise in Georgia. Nursing homes, owners, and staff should be held accountable for the injuries caused by abuse or neglect.
