Professional
Kevin Toole is a Senior Associate in Gertler Law Group’s Bankruptcy and Creditors’ Rights Department. His practice has concentrated in the area of business and personal bankruptcy, insolvency, bankruptcy litigation, corporate restructuring, and out of court workouts for over 25 years. Kevin has extensive experience representing debtors, secured and unsecured creditors and trustees in large complex bankruptcy matters as well as working in insolvent credit union liquidations.
Kevin enjoys bankruptcy practice because other areas of the law often come in to play in reorganizing a company or liquidating assets of a failed business making each case different and challenging. The most satisfying aspect of his practice is helping a business recover and keep its employees or ensuring that individuals get the financial “fresh start” that bankruptcy provides.
Kevin has represented parties involved in some of the more notable bankruptcy cases including Enron, Ames Department Stores, Loews Theaters, Halston, Barney’s, Blockbuster and Chipwich to name a few. He has experience as debtor’s counsel in numerous New York and national Chapter 11 cases including the largest CERCLA superfund site case in the United States. Kevin also has extensive litigation experience in the Federal Courts and New York State Courts, both at the trial level and appellate levels. Prior to joining Gertler Law Group, Kevin held positions at both New York City and Long Island commercial and bankruptcy firms.
Kevin has been an adjunct professor at New York Institute of Technology teaching business law in the School of Management and is co-author of Hedge Funds: Law and Regulations – U.S. Insolvency Law (Sweet & Maxwell, London, England, 2001). He held a line officer commission in the U.S. Navy (Reserve) serving from 1987 to 1996 in Navel Intelligence.
