Education and Background
Randall Aiman-Smith received his Juris Doctor degree from the University of California, Berkeley, School of Law, Boalt Hall, where he was an editor for the California Law Review and a Member of the Moot Court Board. Mr. Aiman-Smith has taught legal writing and appellate advocacy at University of California, Hastings College of the Law, and he has been a frequent presenter at continuing legal education events.
Legal Experience
Mr. Aiman-Smith has been an attorney for more than 25 years and now devotes his practice exclusively to representing employees in the state and federal trial courts and courts of appeal. Mr. Aiman-Smith has tried numerous cases to verdict in the state and federal courts.
In 2010, Mr. Aiman-Smith was lead attorney, along with the other attorneys in the firm, in Williams v. Union Pacific Railroad where, after four years of preparation, the firm obtained for plaintiff, an African-American female employee, a jury verdict of $1,670,000. In Rivero v. Surdyka (N.D. Cal. C93-3383) Mr. Aiman-Smith was lead trial and appellate counsel in a civil rights case that lasted 15 years, including trial and three appeals, finally concluding in a judgment for plaintiffs of over $2,300,000.
Mr. Aiman-Smith and the firm have achieved numerous appellate victories. Most recently, the firm achieved a significant appellate victory after losing in the trial court and in a first appeal. After appealing to the Supreme Court, and returning to the Court of Appeal, the firm secured a very favorable decision that makes it easier for employees to gain certification of class actions suing for overtime and missed meal and rest periods. Mr. Aiman-Smith has been counsel for plaintiffs in numerous class actions for employees in cases where employers failed to provide legally required breaks, pay wages, or pay overtime. As much as Mr. Aiman-Smith enjoys obtaining large individual verdicts for his clients, one of his greatest pleasures is prevailing in class actions and delivering checks to hundreds of employees for unpaid wages or missed breaks that they never believed they would get.
